MyDesignMind ("we," "us," "Platform") is committed to fostering creativity while protecting intellectual property rights. This Content & Copyright Policy ("Policy") governs the ownership, usage, and protection of content shared on, uploaded to, or generated by the MyDesignMind platform. By using our Services, you agree to comply with this Policy.

2. Intellectual property rights

2.1. MyDesignMind ownership

All underlying technology and intellectual property rights associated with the Platform remain the exclusive property of MyDesignMind and its licensors. This includes, but is not limited to:

Brand & trademarks: The MyDesignMind brand name, logo, trademarks, and trade dress.
UI/UX design: The Platform's user interface (UI), user experience (UX) design, and visual layout.
Technical infrastructure: Source code, software architecture, algorithms, and technical infrastructure.
AI technology: Proprietary AI models, machine learning datasets, and generation methodologies.
Assessment methodologies: Psychological assessment methodologies and proprietary questionnaires.

2.2. User-uploaded content

You retain all ownership rights to the images, photos, and text you upload to the Platform ("User Content"). However, by uploading content, you grant MyDesignMind a worldwide, non-exclusive, royalty-free, fully paid-up license to:

  • Host, store, and display your content to provide the Services.
  • Process your content through our AI models to generate design results.
  • Use anonymized data for the limited purpose of training and improving our AI models (unless you have opted out via account settings, where applicable).

2.3. AI-generated content

Regarding the images and designs generated by our AI ("Generated Content"):

✅ Commercial license: Subject to your compliance with these terms and your subscription tier, MyDesignMind grants you a perpetual, worldwide, non-exclusive license to use, reproduce, and display the Generated Content for personal and commercial purposes.

⚠️ Originality disclaimer: Due to the nature of generative AI, similar or identical designs may be generated for other users. You may not claim exclusive ownership over the underlying style or composition generated by the AI.

📝 Attribution: You represent that the Generated Content was created with the assistance of artificial intelligence and shall not misrepresent it as solely human-created original artwork.

3. Permitted uses

Your license to use the Platform and Generated Content is subject to the following permissions:

Interior design projects: Use in personal or professional interior design and renovation projects.
Client presentations: Presenting concepts to clients and including them in professional portfolios.
Social media: Sharing on social media platforms (attribution to MyDesignMind is appreciated).
Reference materials: Using designs as visual references for contractors and architects.
Editorial use: Inclusion in blogs, articles, and newsletters with appropriate credit.
Concept development: Using as inspiration and visual concepts for your creative work.

4. Prohibited uses

The following activities are STRICTLY PROHIBITED and constitute a material breach of this Policy:

Reverse engineering: Attempting to reverse engineer, decompile, or extract the source code or AI models of the Platform.
Model training: Using Generated Content or Platform data to train competing artificial intelligence models or machine learning algorithms.
Resale of assets: Selling the Generated Content as standalone stock assets (e.g., selling raw AI images on stock photo sites) without significant modification.
Scraping: Using bots, spiders, or scrapers to bulk download content or data from the Platform.
Impersonation: Misappropriating another user's identity or content.
Illegal content: Uploading content that infringes on third-party copyrights, or is defamatory, obscene, or illegal.

5. User warranties

By uploading content to MyDesignMind, you represent and warrant that:

  • You own the copyright to the uploaded content or have explicit permission from the rights holder to use it.
  • Your content does not violate the privacy rights, publicity rights, copyrights, or other intellectual property rights of any third party.
  • You are not uploading sensitive personal information (PII) or confidential data.

6. DMCA copyright infringement notice

MyDesignMind complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed upon on our Platform, please submit a notice to our Designated Agent.

Required information for DMCA notice:

Signature: Physical or electronic signature of the copyright owner or authorized agent.
Identification: Description of the copyrighted work claimed to be infringed.
Location: URL or specific location on the Platform where the infringing material is located.
Contact: Your address, telephone number, and email address.
Statement of good faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner.
Statement of accuracy: A statement, made under penalty of perjury, that the information in the notice is accurate.

Response procedure:

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing content within 24-48 hours.
  • Notify the user who posted the content.
  • Terminate accounts of repeat infringers in appropriate circumstances.

7. Trademarks

"MyDesignMind," the MyDesignMind logo, and any other product or service names or slogans contained in the Platform are trademarks of MyDesignMind and may not be copied, imitated, or used, in whole or in part, without the prior written permission of MyDesignMind.

8.1. Free user license

🆓 Usage: Personal use only.
⚠️ Restrictions: Generated images may contain watermarks. Commercial use prohibited.
📐 Quality: Standard resolution.

8.2. Pro / Premium user license

⭐ Usage: Full commercial and personal use rights.
✨ Benefits: High-resolution generation, watermark-free images.
💼 Rights: Suitable for client deliverables, marketing materials, and professional portfolios.

9. AI ethics and transparency

10. Enforcement and termination

MyDesignMind reserves the right to take the following actions against violations of this Policy:
